AMERIKAN HIGH COURT TO DECIDE PATENTABILITY OF HUMAN GENES

We called it here first folks. In Genes, Giants, Monsters and Men, and again in Transhumanism: A Grimoire of Alchemical Agendas with co-author Scott de Hart, I have argued that one consequence of the for-the-moment successful corporate bid by such foul entities as Mon(ster)santo to patent their genetically modified organisms is that this would act as a precedent for similar arguments regarding genetic modifications involving the human genome: tinker with it but a little, and that particular tinkered-with sequence becomes a patentable object.

Or at least, that's what will apparently be argued by the injustices of the US Supremes(and yes, I know this article is somewhat dated, but the subject matter and its importance are not):

Now, I have just about as much confidence in the Supremes as a moral and intelligent body as I have in Mon(ster)santo's and Duponzanto's GMOS being harmless and perfectly safe. After all, the Supremes once gave us the Dred Scott decision, in which a black person was defined as only 3/5 of a person.

Granted, the above article makes it clear that only certain genomes that have been artificially tinkered with could be patentable, not the entire human genome itself.

But I submit that in any case, if allowed, it's the camel's nose in the door. Does someone who, for example, receives an engineered human genome as part of genetic therapy owe the patenting company a perpetual royalty for the rest of their lives for the use of its genome? And given the propensity of modified genes to be passed to offspring or even across species, will offspring that contract the modified gene be similarly indentured? Or what about the individual who eats from Mon(ster)santo GMO, becomes ill for an entirely different reason, goes into the hospital, and is discovered to have DNA that horizontally transferred from the GMO to his or her DNA? Duponzanto is well known to have sent their corporate Gestapo to spy on farmers' fields and haul them into court if they are discovered to be growing their patented crops without a license (never mind that such seeds can be eaten by birds and dropped on a farmer's land who has never intended to buy or plant the crud). In such an instance, does that individual have to pay a royalty?

And will the Federal "government" have to pay for all these royalties under the monstrous Obamacare? (And let's call it by its real name: Obromney-Heritage Foundation Care). Of course it will, because it's another way that the insurance corporations and medical conglomerates and big pharmaceuticals can pillage the government they so apparently own.

If that sounds far-fetched, think again, for already Hollyweird has released a movie about bounty hunters whose sole job is to go to people who have received organ transplants and so on, and "collect" on defaulted payments... apparently there's a clause in the contract that the patient forfeits their life if they default...

Of course, all this sounds far-fetched, surreal... it could never happen in a sane country or society.

But that's the point. Our country and society is no longer sane. The lust for power has led to such corruption and total loss of human values and sanity both in the corporate world and in Washington, that sanity is not to be expected.

Therefore, don't count on Chief Injustice John "Diana Ross" and the Supremes to come to anything like a correct decision. When morality, metaphysics, and the sanctity of human life are concerned, it doesn't have a very good track record...and besides, even if it looked like it might come to a sane decision, there could always be that quiet "velvet hammer telephone call" in the middle of the night to make damned sure the swing votes "vote correctly."

That said, I still hope and pray we'll be, for once, pleasantly surprised.

    Ummm…I’m not trying to defend Monsanto, and I’m the last person who will say anything good about them, or the Supreme Court, but Dred Scott, Dr Farrell? The Supreme Court arrives at its decisions based on legal precedent, and Dred Scott is just really 1857. Just don’t think there is a whole lot of legal precedent today that would support a Monsanto claim that we are all Monsanto GMO slaves. I think, based on today’s legal precedents, even the Supreme Court would have to give a hardy “LOL” to that legal argument. Okay, I’ll grant that the culture is in decay, and yes, Monsanto is evil, but there are different laws today, so I’m not going to put on my tin foil hat just yet. I’m aware that at some point the demon sorcerers might make it legal to yank out my beating heart and toss my dead corpse off of a Mayan Ziggurat, but I have some silver, Tangy Tangerine, and camping skills, so I should be safe.:)

    Regarding royalty payments though, it’s interesting to me that Monsanto has spent so much money to defeat California’s Prop 37. Considering that licensing agreements fall under contract law, and for there to be a valid contract, there must be an offer and an acceptance, if Monsanto would label all their GMO food, they could argue that there was an offer made of GMO food, and the customer accepted the offer when he purchased and ingested the labeled food. Now though, I would think that it would be hard to make that argument, since the customer has no idea what he is purchasing, and therefore the customer cannot be said to have accepted any kind of licensing agreement, and therefore is not responsible for any kind of royalty payments. Also, Monsanto has made an overt effort to ensure that their food is NOT GMO labeled, which is evidence to me that they are in no way offering a licensing agreement, and even willing to spend lots of money to ensure that there is nothing that can be construed as a licensing agreement, attached to their GMO food. Maybe this is why they spent all the money, because I really had to wonder, “why spend all that money so they don’t have to label their food, because it’s not going to make any difference to the Wal-Mart sheeple” The sheeple know there is sodium fluoride in their water. Doesn’t stop them from drinking it. Actually, they spend a buck on a bottle of water because they charcoal filter out the chlorine and it tastes a little better. They could start a whole new line of “really tasty GMO food” and all the happy Wal-Mart shoppers would max out their credit cards buying the tasty new GMO food.

    There was a Coast to Coast am on people who eat GMO food and develop a terrible rash. I wondered, “why in the world don’t you go get a personal injury attorney and sue Monsanto.” You could subpoena all Monsanto’s research. For that matter, what about these farmers who are being sued because some other farmer’s Round Up Ready pollen blew into their field. Since they are going to be defending against a lawsuit anyway, why not file a counter suit and sue Monsanto, and argue that Monsanto is guilty of trespassing, and that they damaged your crops.

    I, too don’t have much confidence in the Courts. The same Court that ordered Floridians to stop counting the vote and pronounce Bushy-boy President (as if the runner up was much better?????) is now going to decide… and so on and so forth!

    This is not concerning the article: I just wandered in and finally bought another one of Your books Joseph. In fact I paid full price for it instead of the used versions out on the market online? ( do you get any royalities from the sale of used books by you?)

    Well anyway, I also ordered your Transhumanism book (which was what I was looking for in the first place?) and I’ll probally pick it up at the store when it comes in next week. (what with mail being slow over the holidays)

    Over at Cambridge’s unique book store called the “Seven Stars Book.”. I went there once before and found they had one of your books on the shelf. (Big deal, right? but this time I asked the clerk — Do you have any books by Joeseph Farrel and he led me to five or six more by you. I was suprised even though I don’t particular like their prices — very few bargins (pricey) but I do like a lot of their selection! As a matter of fact when I momentarily chattered with the clerk he recommended I read Holly Alliance because the Author was a personal friend of his. That impressed me! ) (I think it’s because, come to think of it, he was the owner and not the clerk. I don’t care much for the clerk for he looks like the type who would sell 150 worth of crytals to someone who could spend their limited money on something more worthwhile but I guess he’s good for business for everybody has to earn a living and it is a business establishment, Right! – —Wrong? but I am just gossiping now.

    Well, anyway I ended up walking out with ‘Saucers, Swastikas and Psychops after after reading the excellent “Table of Contents and giving it the once over.” I’m up to page 97 and I must admit I am not disappointed.

    Your getting better with Age, ha, ha! ( I am keeping my fingers crossed on the Transhumanism book. I hope I am not disappointed but given the progress you are showing in your books, I don’t think that will be the case?

    Also, on page 89 I realize your up to your old tricks piling on the tech-talk as in quote 1. A plasma arc reactor for …. ending in 13. …admitting said gas to said reaction chamber ….!

    I believe you once wrote on this site you grew up with a father that is or was an Engineer? It’s no wonder. Mine was a Merchant Marine! ( I wont hold it against you for I realize you are trying to reach a larger audience who just may be in positions to make a difference even if their TOO CHICKEN to announce the worth of your writtings or the pains you must go through orginizing the complexity into ‘readible” paragraphs! (I really like the 1’s,2. and the a.’s, b.’s and c.’s —- It is this guys opinion that it brings your writings as I would say, “down to Earth,” and you would probably say, “Terresterial” if you don’t mine my meaning wit or lead. ( I sink like a stone swimming the deep waters you fly in!)

    One suggestion for I know you don’t have much money because I noticed very small typo errors. Do you do the proof-reading yourslef?) but please add a table of contents to your books over at Amazon. Maybe it would sell more books? Then again, Who knows?

    I wish you and all the members a Happy 2013 ( isn’t 13 an unluckey number? Gulp— I just wish it aint a repeat of 2012?)

    You must know if I was working somewhere as a scientist and I put my name on your web site I might find myself in deep doo-doo! or then I might get laughed at by my fellow workers or even worst, noticed by some over-seer of a higher management. (maybe it’s all moot this self-censureship business because of all this computor spying going on but I imagine it doesn’t hurt Bosses who think it keeps the rabble on their toes even if the rabble wears white coats, ha, ha!

    In a way how could certain elites understand fully some of your writings if they don’t possess ….. Maybe the smart one would but not all of them?

      my father (incredibly physically fit- he had muscles bulging out of his lips) was a US WW2 Jeep driver in the UK who died at the ripe old age of 38 due to “a heart attack” in NE Ohio under questionable circumstances- no, I’m not making this up-

      but do read Dr. Farrell’s “Transhumanism”- it’s a “doozie” and it explains so much more and may answer some of your questions-

        One thing I forgot to bring up about my experiences reading Saucers, Swastikas, and Psychops that I really appreciate is this:
        At the back of the book un der c.) conclusions or the other side of the last page Farrell writes the following —“…, reading the tea leaves of events, ….

        The articles he post on his web site suddenly makes more sense to me. His choice of topics do get scattered all over the place and sometimes it can get a bit confusing, but if Joe is reading tea leaves or tossing sticks like they do in the I Ching then it all falls in place. “He’s looking for proof to back up his thesis of a Break-away Civilization. ” (Now that makes much better sense to me.

        I have to remind myself at times that Joe is human too and puts his pants on one leg at a time even if he did graduate from you know where – that fraudulent university?

        The rest of that sentence I quoted goes on as such, “…reading the tea leaves of recent events, and ascertaining if the signatures of those events evidenced the types of physics being outlined here.”

        It’s such a minor quirk for there are much more important areas of the book I have read so far but still?

        I add a little of the personal just as FarrelI does? I am going on the assumption that Doctor Farrell really does want to find the real definition of what a human being is or what Humanity is? (less people forget and lose something very valuable in the drive for genetic perfection!)

        I would guess the loss of the ‘feeling of pain” is one of those things people would like to forget about permenantly? Not needless or senseless pain but just the kind of pain like ordinary toothache bring which drive us to get help and saves the tooth if it isn’t too late!

    if the following is believable than the Amerikan High Court deciding to patent human genes must expand its horizons big-time-

    although I would’ve initially balked at Dr. Ketchum’s YouTube interview without first having read David Paulides’ dual-volumn “Missing 411” about 411 documented cases of absolutely unexplainable disappearances in the American/Canadian wilderness (just scratches the surface as DP states), Dr. Melba Ketchum’s posted interview (truncated version) is riveting if one has the time and interest and, above all, an open mind-

    the Paulides books in combination with the Ketchum interview connect many dots-

    I wouldn’t be surprised if more people would be more open to the concept that we have genetic cousins out there in the universe as opposed to the fact that some of our genetic cousins just may be among us in hiding- I know this inititially seems crazy (who are you telling?)-

    but then reference the Cremo/Thompson “Forbidden Archeology” and the testimonies of Lloyd Pye and Graham Hancock, then read Paulides and then source Dr. Ketchum (then form your own opinion):

    Just to comment on this further.

    What occurs at birth is, the Federal Entity registers a Copyright on the birth name attached to a new born child by its parents at birth. This is a “berth certificate,” or in other words, a bill of lading or ship’s manifest itemizing cargo. Because one’s berth name has a Copyright registered against it making it the intellectual property of the Federal Entity, one does not own what one perceives to be one’s given names. Indeed, each time one uses ones berth name, one is ironically in violation of Copyright law, but this is by design & has the effect of capturing one’s body into Commerce, i.e., the Laws of The Sea or Maritime Law.     What patenting genes implies is ownership. The Corporate State or Master Pretense is in an ages old struggle over ownership of the body. With Whom does “IT” struggle? The Creator God. Simply stated, the Corporate Collective is loath to recognize Divine claims or moral prerogatives, which IT seeks to flood & drown beneath the waters of Corporate Fiction & Legal Pretense. To this end, Obama serves his benefactors as Captain (Dictator) in Maritime Law of Slave Ship America. Under Obama, Executive Orders constitute the orders of a Ships Captain, not lawful constitutional prerogatives as trustee for the Office of President of the several united states. The whole country – citizens and all natural and domestic resources – can be claimed when the banksters/globalist debt collectors come. Just a thought and maybe a bit too far out on the limb where Dr. Farrell oftentimes likes to venture!

    Patents were first given for original ideas & designs, not seeds & life forms. A patenting of human DNA, animals & perversions like GMO seed stock must be 100% outlawed. Further, the presumption surreptitiously gifted to Corporate Entities that for purposes of privacy & free speech, they are Legal Persons with the rights of a human person, must be rescinded.

    Corporate Entities are Legal Fictions lacking totally in moral conscience. Only human beings have a potential to think & act independently with moral & ethical volition, for which “science” is seeking a “gene” that can be “turned off” or palliated with chemical drugs. The idea is, if the “moral gene” can be turned off, the immoral will beable to go about their business unhindered by guilt or conscience. Call it the new chemically induced “moral labotomy.”

    The Corporate “Person” is not a human being. Thus, human beings must not be subject to them, but Corporate Entities subject to human beings & their lawful prerogatives & needs. This is the original American arrangement between Legal Entities & the people — a government “of, by & for the people,” not “of, by & for the Corporation.” And as the people’s trustee for the Office of President Abraham Lincoln intimated at Gettysburg, that a government of, by & for the people, “should NOT perish from the earth.”

    this is a little out there regarding the subject matter.aside from the specific gene patenting insanity…power insanity??didn’t bill gates say he had to build fort knox around himself just to protect his first billion $$.a little like going to the park and feeding the ducks/ carp with a loaf of old dry bread.they go ape sh%$##$t when you throw a handful to them…as the political scene is wacked out and mamon being controlled by the borg they (billionairs club) now be desperados having a free for all..while the gettin is good so to speak..tomorrow ????????

    Looks like the asylum’s been chasing the monkey around the mulbery bush so long they’ve become weasels. I often check the leader’s tails(tales) to see if their rats are weasels. But with all these Mon(ster)santos & Dupontzillas running amok, it’s getting more & more difficult to make any sense of their actions; except, stickly in terms of cents, adding up to: stratospheric nonsense.

        How about having to take your shoes off just to enter the Federal Building in Boston to make a short visit to the VA offices upstairs like I had to do recently. AND, it wasn’t just an unsavory looking character like myself (not really) but everybody else including little old ladies! (Now if I was a terrorist I’d just fake the badge and look like mister Nobody and pass through the line for employees on the opposite side of the building?)

        Now if that isn’t some kind of dog-obedience training for the General Public or What than I don’t know anything?

        I really like Roberts mention of a drug bust. Don’t do anything illegal or get booked for jaywalking because they just might take a look up your (I’ll say it scientifically) Colen to see if your stashing anything your not supposed to have.

        Which reminds me of a joke about Ophra Winfrey passing thr airport security but I wont because even I’m not that perverse, Ha, ha!

    The Dred Scott decision did not define blacks as “3/5 of a person”.
    You are (rather sloppily) confusing the “3/5 compromise” made during deliberations for the US Constitution–which refers to representation–with the Dred Scott decision, which returned Dred Scott to his former owner. In an “obiter dictum”, Taney argued that the US Constitutional Government had been set up for the benefit of white people, and that under its jurisdiction, a black man had no rights that a white man was bound to respect.

      I’m not a lawyer but the words Underclass scare me after reading about the Roman Legal Concept of ‘HOMO SACER? Being at the bottom of a Class System is still IN a Class System. Being under-class means or is OUT of the the Class System entirerly! NO rights at all!

      From what I read one could do anything they want with such people. Even murder them! The one thing you couldn’t do with them was use them for a sacrifice to the gods because they weren’t (I’m guessing here) considered purified enough. (I don’t know for sure about this?)

(Isn’t this something Farrell is trying to get across to people with his views on trans-humanism? I believe so but then I could be wrong?)
